Arizona law for landlords
What Arizona landlords and property managers must do with a security deposit, and how a sealed tenant scan helps you meet each rule.
Security deposits and prepaid rent together may not exceed one and a half months' rent, unless the tenant voluntarily prepays more.
At move-in, furnish a signed lease, a form for specifying existing damage and written notice that the tenant may attend the move-out inspection. A tenant-completed scan supplements this paperwork; it does not replace it.
Within fourteen days, excluding Saturdays, Sundays or other legal holidays, after termination of the tenancy, delivery of possession and demand by the tenant, the landlord must provide an itemized list of deductions and any amount due. Unless the tenant makes other arrangements in writing, these must be mailed by first class mail to the tenant’s last known residence.
Unpaid rent and damage beyond ordinary wear and tear. Fading, minor scuffs and normal aging are not deductible.
A landlord who wrongfully withholds can owe the amount withheld plus damages up to twice that amount. A sealed move-in and move-out comparison can help document the condition relevant to deductions.
See how to respond on time with an itemized, evidence-backed statement.
